1. Eligibility
You must be at least 18 years old to use EvidenceFit.
By using the Service, you represent that you are at least 18 years old, have the legal capacity to enter into these Terms, and your use of the Service complies with applicable law.
2. What EvidenceFit Does
EvidenceFit is an AI-assisted career-development platform. Depending on the features available to you, EvidenceFit may help with resume analysis, resume rewriting and tailoring, job-description analysis, career evidence organization, interview preparation, interview roleplay, interview feedback, professional accomplishment analysis, transcription, career-related recommendations, and other related tools.
Features may change over time.
3. Beta and Early-Access Service
EvidenceFit may currently be offered as a beta, pilot, preview, or early-access service.
You understand that beta software may contain bugs or errors, operate differently than expected, experience interruptions, have incomplete features, change without notice, produce inconsistent results, and lose or require reconstruction of information in exceptional circumstances.
You should maintain your own copies of important resumes, job descriptions, interview materials, and other career information.
We may add, modify, suspend, limit, or remove beta functionality at any time.
4. Your Account
You are responsible for activity performed through your account.
You agree to provide accurate account information, maintain the security of your account and authentication method, promptly notify us if you believe your account has been compromised, not share access in a way that circumvents account or usage restrictions, and use the Service only for lawful purposes.
We may restrict access to beta users, approved users, particular account types, or geographic regions. Access to a beta does not guarantee continued or future access to EvidenceFit.
5. Your Content
"Your Content" means information or material you provide to EvidenceFit, including resumes, job descriptions, career history, accomplishments, interview answers, interview recordings, uploaded files, professional evidence, instructions, and other materials you submit.
You Keep Ownership
As between you and MRAB AI Labs, you retain ownership of Your Content.
These Terms do not transfer ownership of your resume, career history, interview responses, or other submitted material to us.
Permission Needed to Operate EvidenceFit
You grant MRAB AI Labs a limited, non-exclusive right to host, store, reproduce, transmit, process, format, analyze, and otherwise use Your Content only as reasonably necessary to provide the Service, perform operations you request, maintain and secure the Service, troubleshoot technical problems, comply with law, and exercise rights or obligations under these Terms and our Privacy Policy.
This permission ends when the relevant information is deleted, except where continued retention is permitted or required by law, backup processes, security requirements, or legitimate dispute-resolution needs.
6. Your Responsibility for Submitted Content
You represent that you have the right to provide the information and material you submit to EvidenceFit.
You must not knowingly submit material you do not have permission to use, another person's confidential personal information without authorization, unlawfully obtained information, trade secrets belonging to others without permission, malicious code, content intended to compromise the Service, or unlawful material.
You are responsible for deciding what information is appropriate to provide to the Service.
7. Artificial Intelligence
EvidenceFit uses artificial intelligence.
AI systems can produce output that is inaccurate, incomplete, outdated, misleading, inconsistent, overly confident, or unsuitable for your particular circumstances.
AI output should be treated as assistance, not authoritative advice or verified fact.
You are responsible for reviewing and validating generated material before using it.
8. Career and Employment Disclaimer
EvidenceFit does not guarantee employment, an interview, advancement to a later hiring stage, an offer, a particular salary, improved applicant-tracking-system performance, recruiter or employer acceptance, interview success, or any other employment outcome.
Resume scores, job-fit information, interview feedback, coaching suggestions, evidence analysis, and similar outputs are tools intended to help you think, prepare, and communicate more effectively.
They are not hiring decisions and do not represent the views of any employer unless explicitly stated otherwise.
EvidenceFit is not an employment agency, recruiting agency, law firm, immigration adviser, financial adviser, or professional licensing authority.
9. Accuracy and Truthfulness
EvidenceFit is designed to help users communicate their genuine professional experience more effectively.
You remain responsible for ensuring that resumes, applications, interview responses, and other materials you use are truthful and accurate.
You must not use EvidenceFit to knowingly fabricate employment history, education, credentials, certifications, accomplishments, performance results, professional experience, or other material qualifications.
AI-generated wording does not relieve you of responsibility for the accuracy of material submitted to employers or other parties.
10. Third-Party AI and Service Providers
EvidenceFit may rely on third parties for services such as cloud hosting, authentication, artificial intelligence processing, transcription, databases, storage, communications, and security.
Your use of certain functionality may require information to be processed by these providers.
Our handling of personal information is described in the EvidenceFit Privacy Policy. Third-party services may also have their own terms and privacy policies.
11. Acceptable Use
Your use of EvidenceFit is also subject to the EvidenceFit Studio Acceptable Use Policy (the "AUP"), which is incorporated into these Terms by reference.
You may not use EvidenceFit to violate law or regulation; infringe another person's intellectual-property or privacy rights; impersonate another person; gain unauthorized access to an account, system, or network; circumvent authentication, rate limits, usage limits, quotas, or security controls; probe or exploit vulnerabilities without written authorization; introduce malware or harmful code; scrape or systematically extract the Service except where expressly permitted; interfere with Service availability; reverse engineer components except to the extent applicable law expressly permits; use automated means to place unreasonable load on the Service; use EvidenceFit primarily as a general-purpose transcription or processing service; fraudulently obtain employment or professional credentials; generate unlawful, abusive, deceptive, or harmful material; or assist another person in doing any of these things.
We may investigate suspected misuse and may warn, limit, suspend, or terminate access where reasonably necessary under these Terms or the AUP.
12. Usage Limits
We may apply reasonable technical or operational limits including request limits, rate limits, concurrency limits, transcription-minute or recording-duration limits, file-size limits, AI-usage limits, spending or cost safeguards, storage limits, account or plan allowances, and beta-access restrictions.
These controls help protect users, system availability, third-party service capacity, and operating costs. Limits may vary by beta status, trial, complimentary access, subscription plan, feature, or operating conditions and may change over time.
Access to all available product features does not mean unlimited use of metered infrastructure, transcription, AI processing, storage, or other third-party processing resources.
13. Feedback
If you voluntarily provide suggestions, bug reports, feature ideas, or other feedback about EvidenceFit, you grant MRAB AI Labs permission to use that feedback to develop and improve the Service without obligation to compensate you.
This does not give us ownership of your resumes, career information, or other private content.
14. MRAB AI Labs Intellectual Property
EvidenceFit and its underlying software, interfaces, branding, designs, workflows, documentation, and other materials provided by MRAB AI Labs are owned by MRAB AI Labs or its licensors and are protected by applicable intellectual-property laws.
Except for the limited right to use the Service under these Terms, no intellectual-property rights are transferred to you.
"EvidenceFit Studio," related logos, and associated branding may not be used in a way that suggests endorsement, sponsorship, or affiliation without permission.
15. AI-Generated Output
Subject to applicable law and any rights of third parties, you may use output generated for you through EvidenceFit for your personal or professional purposes.
Because AI systems may generate similar or identical material for different users, we do not guarantee that generated output is unique or eligible for copyright or other intellectual-property protection.
You are responsible for reviewing generated output for accuracy, suitability, confidentiality, and potential third-party rights before using it.
16. Privacy
Our collection, use, processing, storage, and disclosure of personal information are described in our Privacy Policy.
By using EvidenceFit, you acknowledge that information will be processed as described in that Policy.
17. Availability and Changes
We aim to provide a reliable Service, but we do not guarantee uninterrupted availability.
We may maintain or update the Service, add or remove features, change technical providers, impose or revise limits, temporarily suspend functionality, discontinue beta features, or discontinue all or part of EvidenceFit.
Where practical, we will try to avoid unnecessary disruption.
18. Suspension and Termination
You may stop using EvidenceFit at any time.
We may restrict a feature, impose or reduce usage limits, suspend, or terminate your access where reasonably necessary because of violation of these Terms or the AUP, security concerns, suspected abuse or fraud, legal requirements, threats to the Service or other users, excessive or unauthorized use, attempts to circumvent usage controls, termination of a beta program, or discontinuation of the Service.
Where appropriate, we may provide notice or an opportunity to resolve the issue. Serious, intentional, repeated, unlawful, security-related, or materially costly abuse may require immediate restriction or suspension.
19. Disclaimer of Warranties
To the maximum extent permitted by applicable law, EvidenceFit is provided on an "as is" and "as available" basis.
MRAB AI Labs does not warrant that the Service will always be available, will be error-free, that AI output will be accurate or complete, that generated material will satisfy an employer, that use will produce a particular career outcome, that data will never be lost, or that every defect will be corrected.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded under applicable consumer-protection or other laws.
20. Limitation of Liability
To the maximum extent permitted by applicable law, MRAB AI Labs will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the Service, including loss of employment opportunity, income, business, reputation, anticipated savings, data, or profits.
Where liability cannot lawfully be excluded, MRAB AI Labs' liability will be limited only to the extent permitted by applicable law.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
21. Indemnity
To the extent permitted by applicable law, you agree to be responsible for claims, losses, liabilities, and reasonable costs arising from your unlawful use of EvidenceFit, content you submit without necessary rights or permission, your material violation of these Terms, or your intentional misuse of the Service.
This provision does not apply to the extent a claim results from MRAB AI Labs' own unlawful conduct or negligence where liability cannot lawfully be excluded.
22. Electronic Communications
By using EvidenceFit, you agree that we may send Service-related electronic communications such as security notices, account notices, beta-access messages, service changes, legal notices, and other communications necessary to operate your account.
Marketing communications, if introduced, will be handled separately and in accordance with applicable law.
23. Changes to These Terms
We may update these Terms as EvidenceFit evolves.
For material changes, we will provide reasonable notice through the Service, website, email, or another appropriate method.
Continued use after updated Terms take effect constitutes acceptance where permitted by applicable law. If you do not agree to updated Terms, you may stop using the Service.
24. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict-of-law rules.
Subject to rights that cannot legally be waived, disputes relating to these Terms or EvidenceFit will be submitted to the courts located in British Columbia, Canada.
Nothing in this section removes rights you may have under mandatory consumer-protection or privacy laws applicable where you live.
25. Severability
If any part of these Terms is held invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
26. No Waiver
If MRAB AI Labs does not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.
27. Entire Agreement
These Terms, together with the Privacy Policy, the Acceptable Use Policy, and any additional terms expressly presented for a particular EvidenceFit feature, constitute the agreement between you and MRAB AI Labs concerning your use of the Service.
